The Ministry of Justice has registered the regulations for a unified register of unscrupulous contractors, as reported by the legal information channel of the agency.
This document outlines the procedure for the formation and maintenance of the register of contractors involved in state procurement who have committed serious violations. The Ministry of Economy and Finance is tasked with carrying out these responsibilities.
The register will include information about companies found guilty of failing to fulfill contractual obligations or performing them inadequately. Exceptions will be made for cases where the violations were caused by force majeure circumstances.
Additionally, contractors who submitted false information or forged documents during state procurement will be deemed unscrupulous. Grounds for inclusion in the register include the failure to disclose information regarding the affiliated status of the participant or conflicts of interest.
The register will also encompass winners of procurement procedures (bids, tenders, competitions) who refuse or evade entering into a contract with the customer and conducting procurements under the agreed terms following the procedure. Finally, it will include contractors found guilty of fraud and corruption by a court.
Contractors will be automatically removed from the register two years after their inclusion in the list. However, early removal may occur based on a court decision.
